Terms of use

Version 1.3 · 14 October 2026 · Get Carter is operated by Cartercarter Pty Ltd (Australia). The terms are unchanged from version 1.2; the privacy policy, which forms part of them, was updated for forms found on your site and orders from your shop.

These terms cover your use of Get Carter. They are written to be read, not to be impenetrable. If something here doesn't suit your situation, email us and we'll talk about it rather than pretend the small print settles it.

1. The service

Get Carter records visits and enquiries on websites you own or are authorised to operate, and — where you have added them — keeps a contact book, sends email, and provides an assistant that works over your own data. Tracking is provided free. Add-ons are month to month, and you can remove any of them at any time.

2. Your account

3. Your data

4. Sending email

Email sending is not switched on automatically. We review each account before enabling it, because one careless sender damages deliverability for everyone on the platform. When it is on, these rules apply.

Permission

5. Acceptable use

You may not use Get Carter to create, store, publish or send any of the following. This applies to email, SMS, landing pages, social posts and anything the assistant produces for you.

Not allowed, at all

Handled with care

Gambling, alcohol, tobacco and vaping, dating, cryptocurrency and multi-level marketing are not banned outright, but they need a conversation first and may be refused. Tell us before you start rather than after.

6. What we do about it

7. Fair use, uptime and money

8. What you are responsible for

Everything you send or publish is yours, legally

Get Carter is the tool. You are the publisher and the sender. You are legally responsible for every email, SMS, landing page, social post and anything else that leaves the platform under your name — including anything our assistant drafted for you and you approved.

Drafts the assistant produces are suggestions, and a connected AI of your own can read and draft but cannot send. Nothing sends without someone on your side approving it in the email editor, and the moment you approve it, it is your message. If a third party claims your content harmed them, that is your matter to answer, and you indemnify us for costs we incur because of what you sent.

9. Keeping your own copies

Back up anything you cannot afford to lose

We work hard to keep the service running and your data safe: a separate database per client, nightly encrypted backups, and a restore we test. We are not infallible, and neither is anyone we rely on.

Keep your own copy of anything important. Export your contacts regularly — the button is on the contacts page — and hold your own copies of content, lists and templates that matter to your business. Treat Get Carter as where the work happens, not the only place it exists.

To the extent the law allows, we are not liable for loss of, or damage to, content or data, however caused, including where a backup or a restore fails. We will always tell you what happened and help you recover what we can.

10. Liability

Nothing in these terms excludes, restricts or modifies rights you have under the Australian Consumer Law, and nothing here is meant to. Where our liability can be limited, it is limited at our option to supplying the service again or paying the cost of having it supplied again.

Beyond those rights, our total liability for any claim is limited to the fees you paid us in the three months before it arose, and we are not liable for lost profits, lost business, lost opportunity, or loss of content or data. The service is provided as it is: we do not promise it will be uninterrupted or error-free, or that any email will reach any particular inbox — delivery is decided by mailbox providers, not by us.

11. Ending it

You can stop at any time from the billing page. We can end an account for a breach of these terms, or for any reason with 30 days' notice. On the way out you can export your data; we delete your account 30 days later, with the exceptions in section 3 — backups, our operator log and invoices — running out on the periods the privacy page gives.

12. Changes and law

We'll email you at least 14 days before these terms change in a way that matters, and the version and date at the top will change. These terms are governed by the law of New South Wales, Australia.
